The High Court of the Federal Capital Territory (FCT) has issued a stay of execution on a judgment that led to the eviction of Benue politician Ewaoche Benjamin Obe from his Abuja residence.

Obe, who contested as the African Action Congress (AAC) governorship candidate in the 2023 Benue election, was reportedly evicted from his matrimonial home following a judgment delivered by a Dutse Magistrate Court on September 28, 2024. According to court documents, his belongings were thrown into the street during the eviction.

The property dispute involves Obe's wife, Mrs. Christiana Obe, who allegedly secured a judgment against her husband, claiming ownership of the property and subsequently transferring it to a company owned by her twin brother, Thomas Onuh, called Jesryte Global Resources Ltd.

Court Intervention

In response to the eviction, Obe instructed his legal team to challenge the property title at the FCT High Court. During Wednesday's proceedings, his counsel, Jefferson Uwaifoh, argued that executing the Magistrate Court's judgment would cause "irreparable damages" to his client.

The FCT High Court, presided over by Justice M.A. Madugu, granted the Motion Ex Parte (No: FCT/HC/BW/M/554/2025) approving a stay of execution on the earlier judgment.

The court order, which was pasted on the disputed building and its entrance gate, restrains Mrs. Christiana Obe, Jesryte Global Resources Ltd, Mr. Thomas Onuh, and their agents from "selling, occupying, or conducting any activity in and around the property" located at Sagwari Layout, Dutse, Abuja.

Property Details and Jurisdiction

The property in question is described as a four-bedroom duplex with a detached chalet at No. 8, Ayo Solomon Crescent, Sagwari Layout, Dutse Makaranta, Bwari Area Council, Abuja.

Court records indicate that Chief Obe had initially approached the Dutse Magistrate Court as an interpleader, but that court declined jurisdiction, stating it could not entertain land title disputes, and referred the matter to the High Court.

The FCT High Court also granted an order for substituted service of all court processes on the defendants by pasting them "in a conspicuous place within the res being Plot No. BDT/20 and Plot BDT/22 Sagwari Layout."

The case has been adjourned to July 16, 2025, for hearing.
